{"id":2451,"date":"2013-05-10T20:56:51","date_gmt":"2013-05-11T02:56:51","guid":{"rendered":"https:\/\/myfutureamerica.org\/?p=2451"},"modified":"2013-05-10T20:57:24","modified_gmt":"2013-05-11T02:57:24","slug":"us-secret-service-operation-in-ukraine-was-without-authorization-yaroshenkos-lawyer","status":"publish","type":"post","link":"https:\/\/myfutureamerica.org\/?p=2451","title":{"rendered":"&#8216;US secret service operation in Ukraine was without authorization&#8217; &#8211; Yaroshenko&#8217;s lawyer"},"content":{"rendered":"<div>\n<h1><\/h1>\n<\/div>\n<div>\n<div>Konstantin Yaroshenko with family<\/p>\n<div>Photo: RIA Novosti<\/div>\n<\/div>\n<\/div>\n<div>\n<p><strong>The US special services have conducted a secret operation in Ukraine against a Russian pilot Konstantin Yaroshenko, who\u2019s been sentenced to 20 years behind bars in the United States. <\/strong><\/p>\n<p><strong>The operation was conducted without authorization by Kiev.<\/strong><\/p>\n<\/div>\n<div>\n<p id=\"p_10\">\u201cUkraine\u2019s Prosecutor-General\u2019s Office has officially informed me about that\u201d, lawyer Alexei Tarasov told the ITAR-TASS news agency on Thursday. Tarasov is the lawyer of Yaroshenko, who is held at Fort Dix Federal Correctional Institution in New Jersey.<\/p>\n<p id=\"p_20\">\u201cThe Ukrainian authorities, disappointed at the moves by US special service agents, have confirmed that they have never authorized this kind of activity. Statements to the contrary by the US Prosecutors\u2019 Office are but naked assertions\u201d, the lawyer said.<\/p>\n<p id=\"p_30\">According to Tarasov, it was in Ukraine, where evidence of Yaroshenko\u2019s guilt was gathered, as it follows from the material of investigation, that US special service agents shadowed Yaroshenko, tapped his phone and brought provocative psychological pressure to bear on him.<\/p>\n<p id=\"p_40\">It has now transpired that this was done illegally, to trump up evidence and coerce the pilot to join a criminal conspiracy, the lawyer said.<\/p>\n<p id=\"p_50\">The most active phase of the special operation against Yaroshenko took place in December 2009 and March 2010. Then, he was especially closely watched by the agents, specifically, in Kiev\u2019s posh Intercontinental Hotel, the US lawyer said.<\/p>\n<p id=\"p_60\"><a href=\"http:\/\/english.ruvr.ru\/2013_05_10\/Appeals-process-debates-in-case-of-Yaroshenko-due-on-May-15-in-US\/\" target=\"_blank\"><strong>Appeals process debates in case of Yaroshenko due on May 15 in US<\/strong><\/a><\/p>\n<p id=\"p_70\">The parties to the appeals process in the case of a jailed Russian pilot, Konstantin Yaroshenko, will make their statements on the 15th of this month.<\/p>\n<p id=\"p_80\">Yaroshenko has been sentenced to 20 years in prison in the US and is now serving the term. Presiding judges will be determined on Thursday, said the Russian\u2019s US lawyer, Alexei Tarasov, in an interview with the ITAR-TASS news agency.<\/p>\n<p id=\"p_90\">According to him, the prosecutors have given him to understand that they will litigate any pleas in favour of the Russian\u2019s innocence.<\/p>\n<p id=\"p_100\">Yaroshenko was arrested in Liberia on May 28th 2010 on charges of preparing some major consignments of cocaine for transportation.<\/p>\n<p id=\"p_110\">The arrest was preceded by a secret operation by US special services. The Russian Foreign Ministry earlier repeatedly pointed out international law violations in the case of Yaroshenko, since US special service agents seized a Russian national in a third country and secretly took him to the United States.<\/p>\n<p id=\"p_120\">Voice of Russia, <a href=\"http:\/\/www.itar-tass.com\/\" rel=\"nofollow\">TASS<\/a>, Yandex.ru<\/p>\n<hr \/>\n<p id=\"p_130\">\n<p id=\"p_140\"><a href=\"http:\/\/english.ruvr.ru\/2013_05_09\/VoR-exclusive-Yaroshenko-s-lawyer-says-his-client-was-tortured-part-1\/\">Yaroshenko`s lawyer says his client was tortured<\/a><\/p>\n<p id=\"p_150\">Russian pilot <a href=\"http:\/\/english.ruvr.ru\/2013_05_09\/Only-reason-for-Yaroshenkos-imprisonment-is-expected-evidence-against-Bout-investigative-journalist\/\">Konstantin Yaroshenko<\/a>, who has been serving a 20-year sentence in a US jail, badly needs medical treatment. He was tortured and now has to be urgently examined by urologists, Yaroshenko&#8217;s lawyer Alexei Tarasov said in an exclusive interview with the VoR.<\/p>\n<p id=\"p_160\">Pleadings in the Yaroshenko case are scheduled for May 15. His lawyers will have 30 minutes to examine the evidence and repeatedly proclaim the Russian pilot\u2019s innocence. Previously, they had submitted their argumentation in written form to the Courts of Appeals in New York. The appeal says that Yaroshenko had never negotiated the smuggling of four tons of cocaine from South America to Africa. Neither had he ever visited the United States, which means that theuseof extraterritorial jurisdiction in this case is illegal. Above all this, while in Liberia, Yaroshenko was tortured, and this fact should be viewed as the most solid reason to close the case, Alexei Tarasov says.<\/p>\n<p id=\"p_170\">&#8220;Konstantin frequently reports strong toothache. His torturers in Liberia broke some of his teeth. He was beaten and kicked. Another serious issue is that he was beaten by rubber batons. He remained naked for two days, during which he was tortured and beaten, and now he has bladder pains, too.&#8221;<\/p>\n<p id=\"p_180\">The lawyer says that Yaroshenko was taken to a dentist in a US jail but the fillings he got came out a week later. Now we are negotiating a possibility for Konstantin to undergo urologic surgery. Alexei Tarasov continues:<\/p>\n<p id=\"p_190\">&#8220;Konstantin was examined at a hospital in Trenton, New Jersey. Urologists told him that he needed surgery. He agreed and waited for the date of the surgery to be set. Unfortunately, a month ago the administration of the prison where Yaroshenko has been serving his term said that local medics recommended him not to undergo a surgery.&#8221;<\/p>\n<p id=\"p_200\">The lawyer believes that the surgery was postponed not for financial reasons but because of the position of the prosecution.<\/p>\n<p id=\"p_210\">&#8220;They are unwilling to perform a surgery and additional procedures because it would mean that the authorities will have to admit that he was tortured in Liberia. Right now, prosecutors continue to claim that Konstantin Yaroshenko was never subjected to tortures on the territory of Liberia. A district judge unilaterally made a decision that the matter has nothing do with the case, which is why he said the matter will not be dealt with.&#8221;<\/p>\n<p id=\"p_220\">If the Yaroshenko case is allowed to return to a district court from an appellate court, his lawyers will try to prove that he was tortured in Liberia, something that they say should prompt judges to revise the case. Meanwhile, Yarosheko\u2019s physical condition is on the decline not least due to his incarceration conditions, Tarasov said.<\/p>\n<p id=\"p_230\">&#8220;At the moment, he is behind bars in a mass cell, where more than 10 people are serving their sentences. Many of them were brought to justice for sex crimes.&#8221;<\/p>\n<p id=\"p_240\">In the meantime, an appellate court is yet to decide on the matter, a process that Yaroshenko\u2019s lawyer said is unlikely to be completed before the end of this summer.<\/p>\n<p id=\"p_250\">The Yaroshenko case was discussed during US Secretary of State Jogn Kerry\u2019s recent visit to Moscow. Kerry assured Russian Foreign Minister Sergei Lavrov that the US side will cooperate with Russia on the subject.
