Anna Nikolayev and her husband Alex brought their five-month-old boy Sammy to Sacramento\u2019s Sutter Memorial Hospital after he began exhibiting flu symptoms. He had been diagnosed with a heart murmur at birth, according to News 10, a local ABC affiliate.\u00a0<\/p>\n
Sammy was admitted to the hospital\u2019s Intensive Care Unit, at which point his mother witnessed a nurse administering the baby with antibiotics, apparently without instructions from the doctor.\u00a0<\/p>\n
\u201cI asked her, \u2018For what is that?\u2019 And she\u2019s like \u2018I don\u2019t know.\u2019 And then I said \u2018You\u2019re working as a nurse and you don\u2019t he know what you\u2019re giving my baby<\/em>?\u2019\u201d Anna struggled to explain through her tears.\u00a0<\/p>\n Mrs. Nikolayev added that a doctor said the child should not have been given antibiotics, although they did want to perform heart surgery on Sammy immediately. At that point, Anna said, the couple decided to rush Sammy out of the hospital in search of a second opinion on his condition.\u00a0<\/p>\n \u201cIf [they made] one mistake after another, I don\u2019t want to let my baby have surgery in the hospital where I don\u2019t feel safe<\/em>,\u201d she said.\u00a0<\/p>\n The parents traveled directly from Sutter Memorial to Kaiser Medical Center in Sacramento, where doctors released Sammy to the care of his parents.\u00a0<\/p>\n \u201cI do not have concern for the safety of the child at home with his parents<\/em>,\u201d a note from a doctor said. Anna and Alex were forced to show the note to police, who came to the second hospital, presumably after staff at Sutter Memorial called 911.\u00a0<\/p>\n \u201cThe police showed up there. They saw the baby was fine<\/em>,\u201d Anna told News 10. \u201cThey told us that Sutter was telling them so much bad stuff that they thought this baby was dying in our arms. So police saw the report from doctors and said, \u2018Okay, you guys have a good day,\u2019 then walked away<\/em>.\u201d<\/p>\n But just one day later, police showed up at the Nikolayevs\u2019 home with Child Protective Services (CPS) representatives. Alex met the authorities outside, wondering what multiple squad cars were doing at his house.\u00a0<\/p>\n \u201cI was pushed against the building, smacked down<\/em>,\u201d Alex said. \u201cI said, \u2018Am I being placed under arrest?\u2019 He smacked me to the ground and yelled out \u2018I think I got the keys to the house<\/em>!\u2019\u201d\u00a0<\/p>\n Alex later told reporters, \u201cIt doesn\u2019t seem like parents have any rights whatsoever<\/em>.\u201d\u00a0<\/p>\n During the commotion in the driveway Anna had set up a camera pointing at the door. At least four police officers, who did not have a warrant, are shown on film barging into the home followed by CPS workers demanding Sammy.\u00a0<\/p>\n \u201cI\u2019m going to grab your baby, and don\u2019t resist, and don\u2019t fight me, okay<\/em>?\u201d one policeman can be heard telling Anna.\u00a0<\/p>\n Explanations have been hard to come by. Law enforcement referred media requests to CPS, who refused to offer a definitive statement other than claiming Sammy was taken because of \u201csevere neglect<\/em>,\u201d a vague definition the Nikolayevs have denied.\u00a0<\/p>\n \u201cWe conduct a risk assessment of the child\u2019s safety and rely heavily on the direction of health care providers<\/em>,\u201d CPS said.\u00a0<\/p>\n The Nikolayevs and their attorney, Joe Weinberger, expressed disbelief that Sammy was still in the hospital without their consent during an interview with the ABC affiliate.\u00a0<\/p>\n \u201cIt\u2019s absolutely amazing to me how a government can reach out and snatch a child after a doctor said there\u2019s not an issue<\/em>,\u201d Weinberger said. \u201cAs we\u2019ve seen, there is no emergency situation in this case…I can\u2019t imagine having my baby ripped from my arms<\/em>.\u201d<\/p>\n A court hearing is scheduled for Monday, April 28.<\/p>\n![\"A](\"http:\/\/rt.com\/files\/news\/1e\/e1\/90\/00\/screen_shot_2013-04-27_at_8.15.15_am.jpg\")
