Palestinian President Mahmoud Abbas has signed the Rome Statute, the founding treaty to join the International Criminal Court, a day after the UNSC failed to adopt the Arab coalition’s bid for the creation of a Palestinian state.

The Palestinian Authority could also schedule a date for applying to join the International Criminal Court and other international agencies, negotiator Saeb Erekat said, adding that officials would hold a“very serious meeting” on Wednesday.
“There will be no more waiting, no more hesitation, no more slowdown,” Erekat said. “We are going to meet and make decisions.”
A batch of newly signed treaties will be delivered to Secretary-General Ban Ki-moon’s office by the end of the week, a diplomat at the Palestinian UN observer mission told Reuters.
The Rome Statute is the ICC’s founding document. With Palestine becoming party to it, the International Court would have a free hand in assessing all alleged war crimes committed on Palestinian territory.
Although it should be noted that Israel isn’t a member itself, and only its own membership, in addition to Palestine being a signatory, could open it up to ICC investigations.

“It is thus most regrettable that the Security Council remains paralyzed,” Permanent Observer of Palestine to the United Nations Riyad Mansour said, but Palestine “must now consider its next steps.”
According to Mansour, at UN Security Council it was time to end the “abhorrent Israeli occupation and impunity that has brought our people so much suffering.”
The United States has called the Palestinian decision “an escalatory step” saying it “will not achieve any of the outcomes most Palestinians have long hoped to see for their people.”
“Actions like this are not the answer,” spokesman Jeff Rathke said in a statement.
Israeli PM Benjamin Netanyahu has threatened “steps in response” to Palestinian President Mahmoud Abbas’s approach to the International Criminal Court, Reuters reported.
Netanyahu also pledged to protect Israeli soldiers from any potential prosecution.
The Israeli court could also target the Palestinians regarding Abbas’ unity deal with Islamist organization Hamas,
Netanyahu said, describing it as “an avowed terrorist organization which, like ISIS, carries out war crimes.”
The draft resolution on Palestinian statehood gathered only eight votes in favor, so it was automatically defeated. The US still used its veto power and voted against the resolution. Another veto power state, the UK, along with Lithuania, Nigeria, Korea and Rwanda, abstained from the vote.
The eight votes in favor included France, Russia and China.

The resolution gave 12 months for a “just, lasting and comprehensive peaceful solution” to the Israeli-Palestinian conflict, which it regards as the creation of a “sovereign and viable” Palestinian state based on 1967 borders, as well as the withdrawal of all Israeli forces from the occupied territory by 2017.
In 2012, the UN General Assembly upgraded Palestine from an “observer entity” to a “non-member observer state.”
Palestinian authorities said that if resolution wasn’t passed by UN, they will ask for applying to join international organizations as Palestinian people say they are willing to seek justice for crimes against humanity as well as the war crimes being perpetrated against them by Israel.
Abbas said on Tuesday his administration would “no longer deal” with Israel if the resolution were to fail.
“If the Arab-Palestinian initiative submitted to the Security Council to put an end to [Israeli] occupation doesn’t pass, we will be forced to take the necessary political and legal decisions,” he said.
Israeli authorities said they are “satisfied” with the failure of the Palestinian statehood bid at UN Security Council.
“Every Israeli who wants peace with our neighbors can only be satisfied with the results of this vote,”Deputy Foreign Minister Tzahi HaNegbi told public radio.
Russia’s Foreign Ministry said that Moscow regrets that the resolution on Palestinian statehood bid wasn’t approved “amid serious deterioration in crisis settlement in the Middle East.”
Russia says the Israelis and Palestinians should not let the crisis worsen and should restart the peace process.

The defeated resolution would have affirmed the urgent need to achieve “a just, lasting and comprehensive peaceful solution” to the Palestinian-Israeli conflict within 12 months and set a 31 December, 2017 deadline for Israel’s occupation to end.
It also called for an independent state of Palestine to be established within the 1967 Middle East borders – before Israel captured the West Bank, Gaza and east Jerusalem – and demanded “a just solution” to all other outstanding issues, including Palestinian refugees, prisoners in Israeli jails and water.
Jordan’s UN Ambassador Dina Kawar, the Arab representative on the Security Council, said after the vote: “The fact that this draft resolution was not adopted will not at all prevent us from proceeding to push the international community, specifically the United Nations, towards an effective involvement to achieving a resolution to this conflict.”
US Ambassador Samantha Power said: “We voted against this resolution not because we are comfortable with the status quo. We voted against it because … peace must come from hard compromises that occur at the negotiating table.”

“Российская Федерация сожалеет, что Совету Безопасности ООН не удалось принять поставленный на голосование проект резолюции, который должен был подкрепить общепризнанную международно-правовую базу ближневосточного урегулирования, включающую резолюции Совета Безопасности, Мадридские принципы, Арабскую мирную инициативу”, — заявил Чуркин на заседании СБ.Голосование СБ ООН по палестинской резолюции состоялось во вторник вечером. “За” документ проголосовали восемь членов СБ, включая РФ, Аргентину, Чад, Чили, Китай, Иорданию, Люксембург, Францию.

ТЕЛЬ-АВИВ, 31 дек — РИА Новости. Израиль не оставит без ответа обращение палестинцев по присоединению к Международному уголовному суду, заявил израильский премьер-министр Биньямин Нетаньяху.
Глава ПНА Махмуд Аббас в среду подписал Римский статут МУС, в результате чего ПНА сможет принимать участие в работе суда. Таким образом, палестинцы смогут предъявлять иски израильским чиновникам по обвинению в военных преступлениях на оккупированной территории.”Мы отреагируем и защитим солдат Армии обороны Израиля — самой моральной армии мира”, — сказано в заявлении главы правительства.
Палестинскую заявку на членство в МУС Нетаньяху назвал очередной попыткой “навязать Израилю свою волю” и пообещал, что она будет отвергнута точно так же, как проект резолюции о сроках окончания оккупации, провалившийся накануне при голосовании в Совете Безопасности ООН.

Разочаровавшись в перспективах мирного диалога с Израилем и потерпев неудачу в СБ ООН, палестинское руководство подписало, помимо Римского статута, заявки на присоединение к двум десяткам международных договоров. На подобные попытки добиться признания собственной государственности в обход переговорного процесса Израиль в прошлом не раз отвечал экономическими санкциями против Палестинской национальной администрации.
